This Privacy Policy (the "Policy") is a legally binding agreement between Hirenco ("Hirenco," "we," "us," or "our"), a Canadian corporation, and you ("User," "you," or "your"). This Policy governs your access to and use of the Hirenco website, platform, and any related services (collectively, the "Services"). By accessing or using the Services, you acknowledge that you have read, understood, and irrevocably agree to be bound by all the terms and conditions of this Policy. If you do not agree to this Policy in its entirety, you are expressly prohibited from using the Services and must discontinue use immediately.

1. Information Collection and Use

1.1. Categories of Information Collected

We collect the following categories of information:

  • Personal Data: This includes, but is not limited to, your name, email address, postal address, phone number, professional history, educational background, and resume data. This information is collected directly from you when you register for an account, upload your resume, or otherwise interact with the Services.
  • Usage Data: We automatically collect information about your interactions with the Services, including your IP address, browser type, operating system, referring URLs, pages visited, and the dates/times of your visits. This data is collected using cookies, web beacons, and similar tracking technologies.
  • Derived Data: We may analyze your Personal Data and Usage Data to create Derived Data, such as insights into your skills, experience, and potential job matches. This data is used to improve our AI-powered recommendations and personalize your experience.

1.2. Purposes of Data Collection and Use

We process your information for the following legitimate business purposes, in accordance with applicable data protection laws, including but not limited to the General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA), as amended:

  • Providing and Personalizing the Services: To deliver the Services, customize your experience, and provide you with relevant job recommendations. This constitutes a contractual necessity for users who have entered into a Terms of Service agreement with Hirenco.
  • Improving our AI-Powered Recommendations: To analyze your data and refine our algorithms to provide more accurate and relevant job matches. This processing is based on our legitimate interest in improving the Services and your user experience, unless you have opted out as provided in Section 1.3.
  • Communicating Important Updates: To send you notifications about new features, security alerts, and other important information related to the Services. We may also send you marketing communications, subject to your consent where required by applicable law.
  • Compliance with Legal Obligations: To comply with applicable laws, regulations, legal processes, or governmental requests. This includes, but is not limited to, responding to subpoenas, court orders, or requests from law enforcement agencies.
  • Protecting Our Rights and Interests: To enforce our Terms of Service, protect our intellectual property, and prevent fraud or other illegal activities.

1.3. Opt-Out Provision Regarding AI Enhancements

You have the right to opt out of the use of your Personal Data and Usage Data for AI enhancements. You can exercise this right at any time by adjusting your preferences within your dashboard settings. Upon opting out, your data will no longer be used for the purpose of improving our AI-powered recommendations. However, your data will still be processed for other purposes as described in Section 1.2, where applicable. Note that opting out may affect the quality and relevance of your job recommendations.

2. Data Security

We implement commercially reasonable and industry-standard security measures designed to protect your Personal Data from unauthorized access, use, or disclosure. These measures include, but are not limited to:

  • Encryption: We use encryption to protect sensitive data both in transit and at rest. This includes using Secure Socket Layer (SSL) or Transport Layer Security (TLS) encryption for all data transmitted between your browser and our servers, and encrypting sensitive data stored in our databases.
  • Access Controls: We restrict access to your Personal Data to authorized personnel only, who are bound by confidentiality obligations. We use a role-based access control system to ensure that employees only have access to the information they need to perform their job duties.
  • Firewalls: We use firewalls to protect our network from unauthorized access. Firewalls act as a barrier between our internal network and the external internet, blocking unauthorized traffic.
  • Intrusion Detection and Prevention Systems: We use intrusion detection and prevention systems to monitor our network for malicious activity and to prevent unauthorized access.

Notwithstanding the foregoing, you acknowledge and agree that no method of data transmission over the internet or method of electronic storage is completely secure. Therefore, while we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security. You are responsible for maintaining the confidentiality of your account credentials and for restricting access to your computer or device. You agree to notify us immediately of any unauthorized access to or use of your account.

3. Data Retention

We will retain your Personal Data for as long as necessary to fulfill the purposes outlined in this Policy, unless a longer retention period is required or permitted by law. The specific retention period will depend on the nature of the data and the purpose for which it was collected.

We may retain your Personal Data for a longer period if it is necessary to comply with our legal obligations, resolve disputes, or enforce our agreements. Even if you delete your account, we may retain certain information for archival purposes or as required by law.

Upon expiration of the applicable retention period, we will securely delete or anonymize your Personal Data in accordance with our data retention policies and procedures.

  • Business Transactions: In the event of a merger, acquisition, or sale of all or a portion of our assets, your information may be transferred to the acquiring entity. We will provide you with notice of any such transaction and the opportunity to opt out of the transfer of your information.
  • With Your Consent: We may disclose your information to third parties with your consent. This may include, for example, sharing your resume with potential employers or participating in a marketing campaign with a third-party partner.

We will not sell, rent, or trade your Personal Data to third parties for their marketing purposes without your explicit consent.

5. Third-Party Websites

The Services may contain links to third-party websites or services that are not owned or controlled by Hirenco. We are not responsible for the privacy practices of these third-party websites or services. We encourage you to review the privacy policies of any third-party websites or services that you visit.

Your interactions with third-party websites or services are governed by the privacy policies of those websites or services, and not by this Policy. We disclaim all liability for the privacy practices of third-party websites or services.

6. Children's Privacy

The Services are not intended for children under the age of 13, and we do not knowingly collect Personal Data from children under the age of 13. If you are a parent or guardian and believe that your child has provided us with Personal Data without your consent, please contact us at [email protected], and we will take steps to delete the information.

If we become aware that we have collected Personal Data from a child under the age of 13 without parental consent, we will take steps to delete the information as soon as possible.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HIRENCO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES OR THIS POLICY, EVEN IF HIRENCO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS LIMITATION OF LIABILITY APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF HIRENCO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.

IN NO EVENT SHALL HIRENCO'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES OR THIS POLICY EXCEED THE AMOUNT YOU PAID TO HIRENCO FOR THE SERVICES IN THE SIX (6) MONTHS PRECEDING THE DATE THE CLAIM AROSE, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN SUCH JURISDICTIONS, HIRENCO'S LIABILITY SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

HIRENCO SHALL NOT BE LIABLE FOR DAMAGES RESULTING FROM DATA BREACHES, UNAUTHORIZED ACCESS, OR THIRD-PARTY ACTIONS, EXCEPT IN CASES OF GROSS NEGLIGENCE OR WILLFUL MISCONDUCT BY HIRENCO. IN THE EVENT OF A DATA BREACH, HIRENCO WILL COMPLY WITH ALL APPLICABLE DATA BREACH NOTIFICATION LAWS.

8. Changes to this Policy

We reserve the right to modify this Policy at any time, in our sole discretion. Any changes to this Policy will be effective immediately upon posting of the revised Policy on the Services. We will provide you with notice of any material changes to this Policy, such as by posting a prominent notice on the Services or sending you an email.

Your continued use of the Services after the posting of the revised Policy constitutes your acceptance of the changes. If you do not agree to the revised Policy, you must discontinue use of the Services.
